The case for an ex-college hoops standout charged with felony rape, aggravated kidnapping and aggravated sexual assault in Summit County was delayed until at least April 6.
A change-of-plea hearing slated for Salt Lake County resident Teddy Dupay, 29, in 3rd District Court Monday was rescheduled.
Summit County Attorney David Brickey said he has offered Dupay’s side a plea bargain that would reduce the charges.
The offer includes at least one felony count, Brickey said, who added that Dupay’s side has not responded.
Ed Brass, Dupay’s defense attorney, did not comment about the case as he left court in the Snyderville Basin Monday.
Brass requested Dupay’s case be continued, Brickey said.
“Mr. Brass indicated that he needed more time to talk to his client,” Brickey said. “Some defendants have difficulty accepting facts I suspect Mr. Brass is trying hard to share the reality of the facts with his client.”
Dupay has not commented about the case.
A trial scheduled to begin for Dupay in March was cancelled and a pool of potential jurors was released by 3rd District Court Judge Bruce Lubeck.
The charges stem from a confrontation at Stein Eriksen Lodge last June. Charging documents describe the incident as an attack June 19 in room 119-2. The female accuser lives in Salt Lake County and said she had dated Dupay sporadically for about two years.
Dupay was offered a deal to reduce the charges because the alleged victim lacks credibility and has retracted parts of her account of the evening. The Park Record usually does not print the names of alleged rape victims.
The woman has admitted in court she tried to contact Dupay several times after the confrontation in Deer Valley.
Dupay told officers it got “a little rough,” but denied raping the woman, the charging documents state.
She accused Dupay of hitting and kicking her about 150 times, had bruises on her arm, shoulder and thigh, scratches on her back and a swollen left eye, investigators claim, adding that she also suffered fractured ribs.
Dupay started as a guard for the Florida Gators when the school lost to Michigan State in the 2000 NCAA championship game. A Florida spokeswoman said Dupay played basketball at the school from 1999 to 2001.
