According to the Summit County Attorney’s Office, the following cases were heard on April 13:
Kenneth Edward Barfield, age 63, entered into a plea in abeyance to criminal mischief, which is defined as intentional damage to deface or destroy property, a class A misdemeanor. The court ordered the defendant to pay the plea in abeyance fees to the court, complete 25 hours of community service, and complete other standard terms and conditions.
Mark Wallace King, age 58, pled guilty to three counts of unlawful sexual activity with a minor. Additionally, after considering Mr. King’s history and circumstances, the court commuted his 90-day jail sentence to a 150-day term of home confinement.
Colby S. Russo-Hatch, age 18, pled guilty to possession or use of a controlled substance, a class A misdemeanor. The court imposed a term of 365 days in the Summit County Jail and a fine of $2,500 fine. That sentence was stayed and the court ordered the defendant to complete 12 months of court probation, 50 hours of community service, pay a $500 fine, undergo a substance abuse evaluation and successfully complete any recommended treatment or aftercare and provide proof of completion to the court, and complete other standard terms and conditions.
Jarred Keith York, age 18, pled guilty to assault against a peace officer knowing the person is an officer, a second-degree felony, and failure to stop at command of law enforcement, a class A misdemeanor. Sentencing is scheduled June 1.
Melinda Sophia Arellano, age 27, was sentenced for the offenses of attempted failure to remain at an accident involving serious injury, a class A misdemeanor, and driving under the influence of alcohol/drugs, a class A misdemeanor. The court imposed a term of 365 days in jail and suspended 305 days, and imposed a $2,500 fine. The court suspended $950 for the offense of attempted failure to remain at accident involving serious injury. The court imposed a term of 365 days in jail and suspended 365 days. The court imposed a $2,500 fine and suspended $2,500 for the offense of driving under the influence of alcohol/drugs. The court placed the defendant on supervised probation with Adult Probation and Parole for 36 months, ordered the defendant to serve 60 days in jail with credit for 4 days served, pay a $1,550 fine, comply with standard Adult Probation and Parole conditions including drug and alcohol conditions, and complete other standard terms and conditions.
Jerry D. Garcia, age 49, was sentenced for the offenses of criminal trespass, a class A misdemeanor, and sexual battery, a class A misdemeanor. The court imposed a term of 365 days in jail and a $2,500 fine for both offenses. The court suspended 364 days in jail and $1,500 of the fine for both offenses. The court granted credit for one day previously served. The court placed the defendant on supervised probation with Adult Probation and Parole for 24 months, ordered the defendant to serve one day in jail, pay a $1,000 fine, comply with standard Adult Probation and Parole conditions including drug and alcohol conditions, and complete other standard terms and conditions.
Brian Vincent Mecham, age 40, was sentenced for the offenses of attempted forcible sexual abuse, a third-degree felony, and unlawful conduct/massage practice, a class A misdemeanor. The court imposed an indeterminate term of not to exceed five years in the Utah State Prison and a $5,000 fine for the offense of attempted forcible sexual abuse, and suspended that sentence. The court imposed a term of 365 days in jail and a $2,500 fine for the offense of unlawful conduct/massage practice. The court suspended 245 days jail and $1,750 of the fine for that offense. The court placed the defendant on supervised probation with Adult Probation and Parole for 36 months, ordered the defendant to serve 120 days in jail, complete 100 hours of community service, pay a $750 fine, pay restitution, have no contact, directly or indirectly, with the victim or the victim’s family, abide by Sex Offender Group B conditions, and complete other standard terms and conditions.
James Newell Robertson, age 38, was sentenced for the offense of unlawful sexual conduct with a 16 or 17 year old, a third-degree felony. The court imposed a term of zero to five years in the Utah State prison and a $5000 fine. The court suspended the prison term and placed the defendant on supervised probation with Adult Probation and Parole for 36 months, ordered the defendant to complete 100 hours of community service, pay restitution, comply with Adult Probation and Parole’s Sex Offender A conditions, and complete other standard terms and conditions.
Michael Earl Coppage, age 44, entered into a plea in abeyance to attempted possession or use of a controlled substance, a class A misdemeanor. The court ordered the defendant to pay a $2,000 plea in abeyance fee, have good behavior and have no violations of the law, and complete other standard terms and conditions.
